These Terms of Use ("Terms") govern your access to and use of the website at pbgbarber.com (the "Site"), operated by Cutz By AMP ("we", "us", "our"). By using the Site you agree to these Terms. If you do not agree, please do not use the Site.
1. What this Site is
The Site is an informational website for a barbering business located in Palm Beach Gardens, Florida. It describes services, prices, and hours, and links to a third-party booking platform. Using the Site does not create an appointment, a contract for services, or any professional relationship.
2. Accuracy, prices, and availability
We work to keep the Site accurate, but service listings, prices, durations, and hours can change at any time without notice, and the Site may contain errors or omissions. The prices and availability shown on our booking platform at the time you book are the ones that control. Nothing on this Site is an offer or a guarantee that a particular service, price, time slot, or barber will be available.
3. Booking through a third party
Appointments and payments are handled by GlossGenius, an independent third-party platform we do not own or control. When you book, you are dealing with that platform and are subject to its own terms and privacy policy. We are not responsible for the availability, accuracy, security, or conduct of any third-party platform, and we do not receive or store your payment card details.
4. Links to other sites
The Site links to third parties such as GlossGenius, Instagram, and Google. Those links are provided for convenience only. We do not endorse, control, or accept responsibility for the content, policies, or practices of any third-party site.
5. Intellectual property
All content on the Site, including text, photographs, video, graphics, the Cutz By AMP name and marks, layout, and code, is owned by Cutz By AMP or its licensors and is protected by copyright, trademark, and other laws. You may view and share the Site for personal, non-commercial purposes. You may not copy, reproduce, republish, scrape, sell, or create derivative works from any part of the Site, or use it to train any machine learning or artificial intelligence system, without our prior written permission.
6. Acceptable use
You agree not to use the Site to break any law, to infringe anyone's rights, to transmit malware, to attempt to gain unauthorized access to the Site or its systems, to scrape or harvest data by automated means, or to interfere with the Site's operation or with anyone else's use of it.
7. No warranty
The Site is provided "as is" and "as available", without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted or error-free operation. Your use of the Site is at your own risk.
8. Limitation of liability
To the fullest extent permitted by applicable law, Cutz By AMP and Anthony Hicks will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any lost profits, lost data, or business interruption, arising out of or relating to your use of the Site, even if we have been advised of the possibility of such damages. To the fullest extent permitted by applicable law, our total liability for any claim arising out of or relating to the Site will not exceed one hundred United States dollars (US$100.00).
Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law, including liability for gross negligence, willful misconduct, fraud, or personal injury caused by our own negligence. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
This section is about the Site. It does not limit or waive any right you may have in connection with services physically performed in the shop.
9. Indemnification
You agree to indemnify and hold harmless Cutz By AMP and Anthony Hicks from any claim, loss, liability, or expense, including reasonable attorney's fees, arising out of your misuse of the Site or your violation of these Terms or of any law or third-party right.
10. Services performed in the shop
Barbering services are subject to our Shop Policies, which cover booking, cancellation, late arrival, and service disclaimers. Please read them before your appointment.
11. Changes
We may update these Terms at any time. The "Last updated" date above shows when they last changed. Continuing to use the Site after a change means you accept the updated Terms.
12. Governing law and venue
These Terms are governed by the laws of the State of Florida, without regard to its conflict of law rules. Any dispute arising out of or relating to the Site or these Terms will be brought exclusively in the state or federal courts located in Palm Beach County, Florida, and you consent to the jurisdiction of those courts.
13. Severability and entire agreement
If any provision of these Terms is held unenforceable, that provision will be limited or removed to the minimum extent necessary and the rest will remain in full force. These Terms, together with our Privacy Policy and Shop Policies, are the entire agreement between you and us regarding the Site.
